Conditions

These are the conditions this site can compare with your answers or that matter most. The full list is on the official page.

  • Nomination or sponsorship by an approved Australian employer
  • Under 45 years of age
  • Competent English or better; Or, in the Labour Agreement stream, the English proof the labour agreement sets
  • At least 3 years of relevant skilled work; Or qualify through another stream. Temporary Residence Transition: at least 2 years on a 457 or 482 visa in the 3 years before applying, with 2 years of full-time work for an approved sponsor. Labour Agreement: whatever the agreement sets
  • Direct Entry: an occupation on the Core Skills Occupation List, the same 456 occupations as the 482 (ANZSCO 2022 codes). Temporary Residence Transition: the occupation of your most recent 457 or 482 visa, nominated by the sponsor who last nominated you
  • Direct Entry stream: a suitable skills assessment from the relevant assessing authority, not one made for a 485 visa, that is still valid or was issued no more than 3 years before you apply
  • The employer must pay at least the annual market salary rate, and both that rate and your pay (not counting non-monetary benefits) must reach the Core Skills Income Threshold of AUD 79,423 for nominations lodged 1 July 2026 to 30 June 2027. This is not applied when annual earnings will be AUD 250,000 or more. The Labour Agreement stream follows the agreement
  • The employer must show a genuine need for the job, which must be full-time for at least 2 years with no clause excluding an extension, and that it can pay at least the annual market salary rate each year
  • Meet the health and character requirements

Good to know

  • You must usually be under 45 when you apply. Exemptions include academics and certain scientists and researchers, regional doctors, and 457 or 482 workers who earned above the Fair Work high income threshold (AUD 190,100 from 1 July 2026) in two of the last three years. In the Labour Agreement stream the agreement can set a higher age.
  • In the Temporary Residence Transition and Direct Entry streams you must apply within 6 months after the nomination is approved. The experience check above uses the Direct Entry figure (3 years) as a rough guide only; the other streams use other tests.
  • If you hold or last held a 491 or 494 regional provisional visa, the Direct Entry and Labour Agreement streams require you to have held it for at least 3 years (a labour agreement can set a shorter period). A 494 holder cannot use the Temporary Residence Transition stream.
  • Employer charges: a nomination fee of AUD 540 (none for a Temporary Residence Transition or Labour Agreement position in regional Australia) and a training contribution charge of AUD 3,000 if its annual turnover is under AUD 10,000,000, or AUD 5,000 otherwise. Your application charge (first instalment): AUD 6,140 for the main applicant, AUD 3,070 for each additional applicant aged 18 or over and AUD 1,535 for each under 18 (AUD 5,035 for the main applicant with a Pacific-regional passport). Adults assessed as lacking functional English also pay a second instalment (AUD 9,800 for the main applicant, AUD 4,890 for a family member).
  • A permanent visa lets you travel to and enter Australia for 5 years from the grant. After that, coming back as a permanent resident depends on holding a valid travel facility, such as a Resident Return visa.
