Conditions

These are the conditions this site can compare with your answers or that matter most. The full list is on the official page.

  • Partner who is an Australian citizen, permanent resident or eligible New Zealand citizen and can sponsor you
  • A genuine relationship, judged on all the circumstances: the financial aspects, the nature of the household, the social aspects and the nature of your commitment. You must both be 18 or over. A de facto couple must show at least 12 months together immediately before applying, unless the relationship is registered or compelling and compassionate circumstances exist
  • Your partner’s sponsorship must be approved. It cannot be approved if more than one other person was previously sponsored by your partner as a partner; if there was one, or your partner was themselves sponsored as a partner, at least 5 years must have passed since that application. Compelling circumstances can override these limits
  • Supporting statements (Form 888) from people aged 18 or over who know you as a couple; you may be asked for up to three. You lodge the application online in ImmiAccount
  • Meet the health and character requirements

Good to know

  • The permanent visa (801 or 100) can be granted only once at least 2 years have passed since the combined application was made. The wait does not apply to a long-term partner relationship (at least 3 years, or at least 2 years with a child of both), and the Minister may approve earlier in cases such as the sponsor’s death or family violence. You start the permanent stage in ImmiAccount (Stage 2).
  • Application charge (combined temporary and permanent application, first instalment, from 1 July 2026): AUD 11,710 for the main applicant, AUD 5,860 for each additional applicant aged 18 or over and AUD 2,935 for each under 18 (AUD 9,600, AUD 4,805 and AUD 2,405 with a Pacific-regional passport). The second instalment is nil. Use the Visa Pricing Estimator for your own case.
  • Applications lodged in Australia for a visa that can be granted onshore (820/801) get the highest processing priority under Ministerial Direction 117. Offshore partner applications (309/100) are in a lower-priority group.
  • A Prospective Marriage visa (subclass 300) is a separate visa for people outside Australia who plan to marry their Australian partner. You must have met in person since you both turned 18, and the visa runs for 9 to 15 months. After you marry you can apply for the partner visa at a reduced first-instalment charge (AUD 1,955).
